These Terms of Service ("Terms") govern your use of Safari Car Wash services, including our website safaricarwash.com and physical car wash locations in Franklin, Nashville, and Hendersonville, Tennessee (collectively, "Services").
By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.
1. Definitions
- "Safari Car Wash," "we," "us," "our" refers to the company operating car wash facilities in Middle Tennessee
- "Customer," "you," "your" refers to any individual or entity using our Services
- "Services" includes all car wash services, memberships, wallet passes, detailing services, and website features
- "Membership" refers to unlimited monthly car wash subscription plans
- "Wallet Pass" refers to prepaid multi-wash packages
- "Location" refers to any of our three physical car wash facilities
2. Account Registration
2.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Services. By creating an account, you represent and warrant that you meet these requirements.
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized account access
- Providing accurate, current, and complete information
2.3 Account Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abusive behavior toward staff or other customers
- Excessive or unreasonable use of Services
3. Membership Terms
3.1 Membership Plans
Memberships provide unlimited washes at the enrolled location for a monthly subscription fee. Key terms:
- Location-Specific: Memberships are valid ONLY at the location where you enrolled (Franklin, Nashville, or Hendersonville)
- One Vehicle: Each membership covers one vehicle identified by license plate
- Unlimited Use: Wash as many times as you want during your membership period (one wash per day recommended to avoid excessive wear)
- Service Level: Choose from Basic ($24.99/mo), Premium ($34.99/mo), or Ultimate ($44.99/mo) plans with varying features
3.2 Billing and Renewal
- Memberships automatically renew monthly on the same date you enrolled unless cancelled
- Payment is charged to your provided payment method on the renewal date
- Prices are subject to change with 30 days' advance notice
- Failed payments may result in membership suspension after 7 days
3.3 Cancellation Policy
You may cancel your membership at any time through:
- Your online account dashboard
- Calling your enrolled location
- Visiting your enrolled location in person
- Emailing memberships@safaricarwash.com
Cancellation takes effect at the end of your current billing cycle. You will continue to have access to unlimited washes until that date. No refunds are provided for partial months.
3.4 Membership Transfers
Memberships are non-transferable between:
- Locations: You cannot transfer your membership from Franklin to Nashville or vice versa
- Vehicles: Membership is tied to a specific license plate. Vehicle changes require contacting customer service
- Individuals: Memberships cannot be transferred to another person
4. Wallet Pass Terms
4.1 Pass Types
Wallet Passes are prepaid packages offering discounted single washes:
- 5-Wash Pass: $59 (5% savings)
- 10-Wash Pass: $109 (12% savings)
- 20-Wash Pass: $199 (20% savings)
4.2 Pass Usage
- Valid at any Safari Car Wash location (not location-specific like memberships)
- No expiration date—use washes at your own pace
- Washes are deducted from your pass balance each time you visit
- Check your remaining balance through your online account or at any location
4.3 Refunds and Transfers
- No refunds for unused wash credits on Wallet Passes
- Passes are non-transferable between customers unless gifted through our official gift pass program
- Lost or stolen passes cannot be refunded or replaced without proof of purchase
5. Detailing Services
5.1 Service Availability
Professional detailing services are available ONLY at our Franklin location. Services require advance booking and confirmation.
5.2 Booking and Cancellation
- Deposit: A 50% deposit is required at booking to secure your appointment
- Cancellation: Cancel at least 48 hours in advance for a full deposit refund
- No-Show: Deposits are forfeited for no-shows or cancellations with less than 48 hours' notice
- Rescheduling: Free reschedule if done 48+ hours in advance; otherwise subject to availability
5.3 Service Disclaimers
By booking detailing services, you acknowledge:
- We are not responsible for pre-existing damage (scratches, paint defects, interior wear)
- Certain stains, odors, or damage may not be fully removable despite best efforts
- You must disclose any known issues (pet stains, biohazards) at booking
- Additional fees may apply for excessive filth, biohazards, or mold
- Vehicles must be mechanically safe and accessible (unlocked, keys provided)
6. Service Usage and Conduct
6.1 Acceptable Use
You agree to:
- Follow all posted instructions and staff directions
- Remove valuables and personal items before entering the wash tunnel
- Ensure your vehicle is safe for automated wash (antenna removed, mirrors folded)
- Treat staff, equipment, and other customers with respect
- Not abuse or misuse unlimited membership privileges (e.g., 10+ washes per day)
6.2 Prohibited Conduct
You may not:
- Use fraudulent payment methods
- Share or resell membership access (each membership is tied to one vehicle/owner)
- Engage in abusive, threatening, or disruptive behavior
- Damage equipment or facilities intentionally or through negligence
- Loiter or conduct business on our property without permission
6.3 Enforcement
Violation of these Terms may result in:
- Immediate termination of membership or service access without refund
- Ban from all Safari Car Wash locations
- Legal action for damages or theft
- Reporting to law enforcement for criminal activity
7. Liability and Disclaimers
7.1 Vehicle Damage
IMPORTANT NOTICE: While we take every precaution to provide safe and professional car wash services, Safari Car Wash is not responsible for:
- Pre-existing damage: Scratches, chips, rust, loose trim, or paint defects present before wash
- Improperly secured items: Antennas, roof racks, spoilers, or loose parts that become dislodged
- Vehicle condition: Damage to vehicles with rust, weak paint, or structural issues
- Items left in vehicle: Loss or damage to personal property, valuables, or unsecured items
- Weather-related damage: Wind, hail, or environmental factors beyond our control
7.2 Claims Process
If you believe your vehicle was damaged during service:
- Notify a manager immediately before leaving the premises
- Provide photos of the damage and proof of pre-service condition if possible
- Complete a damage claim form within 24 hours
- Claims will be reviewed and addressed within 7-10 business days
Maximum liability: Our liability for any claim is limited to the lesser of (a) the actual repair cost or (b) $500 per incident.
7.3 Service Limitations
Services are provided "as is" without warranties. We do not guarantee:
- Complete removal of all dirt, stains, or contaminants
- Protection from future environmental damage (bird droppings, tree sap, etc.)
- Specific timing or availability of services (weather, equipment issues may occur)
8. Intellectual Property
All content on our website and materials at our locations—including logos, trademarks, text, images, graphics, software, and design—are owned by Safari Car Wash or our licensors and protected by copyright and trademark laws.
You may not use, reproduce, modify, or distribute our intellectual property without prior written consent.
9. Dispute Resolution
9.1 Informal Resolution
Before initiating formal legal action, you agree to contact us at legal@safaricarwash.com to attempt to resolve the dispute informally.
9.2 Arbitration
Any disputes not resolved informally will be settled through binding arbitration in accordance with the American Arbitration Association rules, conducted in Williamson County, Tennessee.
You waive your right to participate in class action lawsuits or class-wide arbitration.
9.3 Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
10. Changes to Terms
We may update these Terms at any time. When we do:
- We will update the "Last Updated" date at the top of this page
- Material changes will be communicated via email or prominent website notice 30 days in advance
- Continued use of Services after changes constitutes acceptance of new Terms
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
